86% of Millennials prefer to stay and grow within their company
86% of Millennials prefer to stay and grow within their company86% of Millennials prefer to stay and grow within their companyResearch has found that millennials prioritize passion over money when it comes to new jobs, but more recent data makes it clear that they also want to invest in their futures while in the office.New findings fromBridge, which is an employee development suite for businesses, show that 86% of millennials surveyed agreed that if they had career training and development through their employers, they wouldnt leave their jobs.SurveyMonkey polled more than 500 employees working full-time on behalf of Bridge. People ages 18 to 29 were considered millennials, although people of different generations also weighed in.Heres how companies are falling short of expectationsFifty-six percent of millennials think people should stay with the saatkorn company for more than 20 years, and almost 90% of millennials want to advance at the employers they currently work for. But in t erms of spending more than two decades at one workplace, 67% of people surveyed in this generation say they wouldnt stick around if there was no way to move forward there.Emily Foote, VP of Customer Engagement for Bridge, commented on the research in a statement.Millennial employees are looking for something different in their jobs, beyond good compensationThey arent satisfied with routine promotions or pay bumps they want opportunities to learn, develop new skill sets, and grow into leaders. Organizations that create learning environments are rewarded with employee engagement and loyalty, she said. There are a bunch of ways to properly prepare for a performance review with your boss, but one-third of workers in the Bridge survey dont think performance reviews do that much for them- theyre not helpful. Plus, 42% of workers overall would give their employers a C grade or below in terms of how theyre carried out.Citing Pew Research Center data, Bridge shed light on the vast size of th e American workforce, reporting that more than 56 million workers in the millennial generation were either employed or seeking a position as of 2017, compared to 53 million people in Generation X and 41 million Baby Boomers.

Physical Training Uniform Wear Rules in the Navy
Physical Training Uniform Wear Rules in the Navy Physical Training Uniform Wear Rules in the Navy Each branch of the military has separate uniforms for different functions. For instance, combat fatigues are not worn during a formal military ceremony, and dress uniforms are not worn during boot camp. During calisthenics, exercise, and some drills, there is a physical training uniform (PTU). The PTU may also be worn on and off base for fitness or leisure unless determined otherwise by regional coordinators or commanding officers. Navy Requirements The PTU, now available in Navy Exchanges, is required for command and unit physical training, and the semi-annual physical fitness assessment (PFA The basic PTU for sailors includes: A gold long-sleeved or short-sleeved shirt with the word Navy on the left chest area and back of the shirtNavy blue shorts with the word Navy on the left legBlack sweats with the word Navy on the left leg of the pants and the left chest of the sweatshirt.Comfortable running shoes, of any color, are allowed as footwear In 2017, the Navy introduced a long-awaited fitness tracksuit, which is an approved two-piece jacket and pants. The suits were issued to new recruits and were later made available to all enlisted sailors. While sailors pay for the jacket and pants, they get reimbursed for the cost in their clothing allowances. Officers, who dont receive clothing allowances, pay for the cost of the fitness suit out of pocket How to Wear the PTU During command exercise in port, the PTU shirt must be tucked into the shorts; during individual PT, or on liberty, shirts may be worn in or out of shorts. While a sea, the PTU is worn at the discretion of the commanding officer. Shorts must be worn on the waist. The length of the shorts may not extend below the top of the knee. Athletic socks must be worn and shall not extend above mid-calf. Low-cut socks are permitted. Pregnant sailors will wear the shirt out and will discontinue wearing the PTU when it becomes too tight. Female sailors should wear a sport or dress brassiere under the PTU. The tracksuit is meant to be worn over PT shorts and shirts during fitness training, and during the physical readiness test, sailors take twice a year. The jacket should be zipped at least three quarters, and sleeve cuffs should hit at the wrist (this is a uniform after all, and should look tidy). As with other PTU shorts and pants, the tracksuit pants are intended to be worn fully on the waist, with the pant leg hitting the top of the shoe, but not touching the ground. Ball caps are allowed as part of the PTU in inclement weather as long as they are Navy-issue. It is at the discretion of the commanding officer. The PTU cannot be worn while in a duty status or when conducting official business on base such as visiting medical treatment, galleys, or Personnel Support Detachments.

3 Fast and Easy Ways to Avoid Burnout at Work - The Muse
3 Fast and Easy Ways to Avoid Burnout at Work - The Muse 3 Fast and Easy Ways to Avoid Burnout at Work You want to know the problem with the majority of stress remedies you hear? They take a while to set in motion and start working. Same goes with job burnout. And when youâre feeling that overwhelmed and that overburdened, the last think you want to do is set a 30-day plan in motion. No, you want to feel better now. Hereâs how: 1. Just Say No I know that saying ânoâ is easier said than done, but not everything can be a priority. Itâs critical to let the people you work with know you have limited bandwidth, resources, and time. Practice relentless re-prioritization so that any new, more important projects will push older, inconsequential projects to the side unless otherwise specified. A great tool to use to help prioritize activities is the acronym WIN, which stands for the question, âWhatâs important now?â It was coined by motivational speaker and legendary college football coach Lou Holtz in his book, Winning Every Day: The Game Plan for Success. Holtz would have his college players ask themselves the WIN question 35 times a day to help them stay focused on what mattered most in every aspect of their college experience. When this simple, yet powerful, assessment question is coupled with a strong willingness to say âno,â the result is dramatic. This one-two combination will help improve your sense of control, level expectations, maintain a sustainable workload, and realign priorities- all of which dampen job burnout. 2. Goof Off You have permission to mess around right now. Science says so. Educational and behavioral experts have long known the benefits of âplayâ (or mental distraction) when it comes to finding solutions to tricky issues. F.P. Hughes explains the seemingly simple concept is actually composed of three complex, yet beneficial, elements that are applicable to the workplace and help combat burnout. The first elementâs a personality characteristic, which represents a personâs idea of himself and his attitude toward others. While playing, this element tends to manifest as spontaneity, curiosity, and persistence. Next, thereâs an intellectual process that shapes the way we think and problem solve. While psychologists have a tough time putting their finger on the exact point of overlap between play, creativity, and intelligence, they believe it relates to asking original questions, making unusual connections, as well as having relaxed thoughts that focus on analogies and metaphors. Lastly, Hughes points out that the action of playing helps contribute to creative results, which typically take the form of novel solutions, new insights, or process improvements. The bottom line is that when all three of those elements come together, itâs difficult to separate work from play. Itâs truly a magic elixir against stress. So, break out the hacky sack- OK, fine, 2048- now! 3. Relax A February article from Harvard Medical School found that meditation reduces stress, irritability, and anxiety. Plus, it improves sleep. And while an increasing number of Americans are reaping these benefits, still less than 10% of the U.S. population engages in any form of meditation or directed relaxation. If you donât know the difference between a chakra and a piece of okra, turn to YouTube. Seriously! I use this quick 13-minute video by Qi Gong instructor, Lee Holden. While he recorded the video to be used as a nightly relaxation ritual before bed to promote a restful night sleep, I do it first thing in the morning and during lunch to help me relax during the day. Itâs amazing, it works, itâs free, and you can press play right now. Perhaps the most interesting aspect of job burnout is that itâs less about the actual job stress itself and more about the manner in which the person in that job responds to it. Hopefully your preventative response to job stress going forward will be: No. Play. Ohm! Photo of stress ball courtesy of Shutterstock.

5 Social Media Personas You Need to Avoid to Land A Job
5 Social Media Personas You Need to Avoid to Land A Job 5 Social Media Personas You Need to Avoid to Land A Job If youâve heard it once, youâve heard it a thousand times: your social media presence can impact your job search. Well, according to Jobviteâs 2014 Social Recruiting Survey, itâs true. In fact, results from the survey of 1,855 recruiting and HR professionals across different industries suggest that it may have more of an impact than you think. More than 90 percent of respondents said they look at a candidateâs social media profiles before making a hiring decision, but thatâs not all. When asked, one in five admitted to reconsidering a candidate based on their online activity, and 61 percent said those reconsiderations were negative. Clearly, itâs important for job seekers to be vigilant about how they represent themselves online. Here are five âred-flagâ social media personas that all job seekers should steer clear of, or risk keeping hiring managers at armâs length: 1. Bad-Mouth Barry Bad-Mouth Barry is a great candidate. He has the skills, the experience and the personality, but he canât stop saying bad things about his previous employers on Facebook and Twitter. Interestingly enough, he canât figure out why heâs having a hard time finding a new job. What Bad-Mouth Barry doesnât realize is that, according to a 2015 survey, bad-mouthing a former employer or co-worker is ranked in the top three worst things a candidate can post about on social media. If your social media profiles make you look like Bad-Mouth Barry, delete any content about your previous employers ASAP and be careful to keep things positive in the future. 2. No-Show Nina No-Show Nina figures if youâre not on social media, you canât make mistakes that hiring managers will reconsider you for, right? This social media avoidance strategy seems sound, but itâs not as foolproof as No-Show Nina thinks. Consider this: Would you take an interview at an organization that had no online presence? Probably not. Just like you rely on an organizationâs online presence to tell you more about the company, recruiters rely on your social media presence to gain insight into who you are. In fact, 35 percent of respondents in the survey say they are actually less likely to interview a candidate who has no online presence. Instead of choosing the nuclear option, take time to think about everything you put online and make sure it reflects the professional image you want hiring managers to see. 3. Private Peter Like No-Show Nina, Private Peter is wary of the impact social media can have on his job search. So, heâs made all of his profiles private and denies requests from hiring managers who want to be friends. What he doesnât realize is heâs also keeping them from finding out what makes him the right candidate for the job. Making your profiles and the things you post private is a good way to control who sees your online content, but it also means people canât see how knowledgeable or professional you are. When a hiring manager sends a friend request or wants to follow you, take it as a sign they are interested. Denying their requests makes you look like you have something to hide, or worse, that youâre not interested in their opportunities. 4. Inappropriate Irene Inappropriate Irene is the easiest red-flag social media persona to spot. Irene doesnât care who is looking at her profile and has no issue with posting racy photos, drug and alcohol-related content, or expletive-laced comments on her profiles or othersâ. If this sounds like your social media persona, youâve got a tough job search ahead of you. While it may take a long time, do your best to go through your profiles and remove any offensive content that a hiring manager may find, and restrict your permissions on those posts to âfriends only.â 5. Lying Larry Lying Larry is another commonly-rejected job seeker. He not only exaggerates his accomplishments, but also actively lies about them to attract recruiters and hiring managers. When hiring managers try to confirm his qualifications online or determine if heâs really as professional as he seemed in an interview, they find out heâs quite the opposite. When you are searching for a job, your social media persona should reflect who you are as a person and as a professional, and Lying Larryâs does not. Make sure your social media presence isnât negatively impacting your job search by taking some time to review your social media profiles to ensure you donât fit into any of these âred-flagâ social media personas. What does your social media persona say about you? How do you make sure it attracts hiring managers instead of dissuade them? When career isnt enough The power of focus to manifest your dreams
When career isnât enough The power of focus to manifest your dreams When career isnât enough The power of focus to manifest your dreams When I was in high school, I dreamt of becoming a rock star. After all, it was the mid-80s and my heroes were Jon Bon Jovi and Eddie Van Halen. Oh sure, the riches and fame sounded enticing, but I primarily envisioned looking out from the stage and seeing all the smiling faces there to enjoy my music. I had witnessed my middle school classmate Sisaundra singing in class and on the school bus and was inspired by the way she was able to lift peopleâs spirits with her voice.I wanted to have that kind of effect on others. In pursuit of my dream, I took guitar lessons from a young man named Chris Juergensen, who had a passion for playing and teaching guitar. After several years, Chris moved away and I finally gave up on my dream of becoming a rock star. I then set a more realistic career goal for myself and decided to become an attorney. I focused on that goal until I achieved it.Over the years, I have learned that whatever we focus on- on a consistent basis- is what tends to manifest i n our lives. I did not realize my dream of becoming a professional musician because I gave up. Chris Juergensen, on the other hand, focused on being the best guitarist he could be and, as a result, he became a renowned guitarist and author who continues to inspire and educate musicians from Tokyo to New York. And Sisaundra, from middle school, focused on her singing career which led to five world tours with Celine Dion. In addition, she was a principal vocalist for Cirque du Soleilâs La Nouba for a decade and was even a powerhouse contestant on NBCâs The Voice. Indeed, Chris and Sisaundra have achieved unbelievable success by focusing on their career goals, which also happened to be their passion in life.It is important to understand that this concept, âthe power of mental focus,â does not just apply to career goals. That was obviously true because, even after I achieved my own career goal, I focused on what I felt was missing in my life and my worry, doubt, and fear created even more negativity. There were times I considered giving up on not only my career but my life. My negative focus created negative energy that kept people at a distance, prevented doors of opportunity from opening and basically ensured I would never be happy. In 2005, however, I wandered into a fossil shop and bought a fateful souvenir â" a little dinosaur tooth â" that awakened my passion for paleontology and radically transformed my life in a positive way. On the surface, it appeared as though dinosaurs had brought me back to life. In reality, it was my change in mental focus that led to my positive transformation.Yes, Iâm still an attorney and have been for 25 years. But, for the past 14 years, I have also been on an adventure that I am thrilled to share with others. I always enjoy seeing the smiling faces of those who are excited to touch a real dinosaur bone or hear about my latest dig site adventure. You might say I ended up a ârockâ star after all. After years of analy zing my own positive transformation, I now realize my passion for paleontology had four essential characteristics that made it powerful enough to transform my life:1. It was positive and productiveThis oneâs quite simple â" only something positive has the power to transform your life in a positive way. A negative pursuit (i.e. a harmful vice) will inevitably lead to negative consequences, even if it makes you feel happy when youâre pursuing it.2. I was genuinely excited about itUnless you are genuinely excited about your passion, your interest will eventually fizzle and it will not have the power to transform your life for the better.3. It was ongoingFor your passion to help you maintain a positive mental focus and to ensure that you stay on a cycle of positivity, it must be pursued on an ongoing or at least a regular basis. Of course, you will still encounter obstacles and the challenges of day-to-day life. Thatâs just part of being human. But staying positive mentally is a conscious decision that we must work toward daily.4. I shared it with othersThis is another simple but very powerful concept. If you are pursuing something you keep to yourself, it is not likely to transform your life, at least in a significant way. It is through the process of getting out there and sharing your enthusiasm that you will make new friends, new opportunities will open, and you will find your passion truly enriching your life. If, like my friends Chris and Sisaundra, you are pursuing a career that is also your passion, then kudos to you. You are already living the dream! If, on the other hand, you have a good job, but still find yourself focused on negativity or simply stuck in a rut, itâs time to find your passion â" regardless of whether you ever turn it into a career. Your true and life-changing passion is like a dinosaur skeleton buried in the ground. Youâre not going to find it until you seek it out and uncover it.Once you are pursuing a passion that meets the four criteria, your positive thoughts and enthusiasm will produce positive energy which will draw the best things possible into your life!Attorney Elaine Howard transformed her life from one of despair and hopelessness â" after battling academic struggles, low self-esteem, and an eating disorder â" to one of excitement and adventure when she inadvertently discovered paleontology. Over the past 14 years, Howard has become certified in fossil lab and fieldwork by the Wyoming Dinosaur Center and participated in many dinosaur digs. As a certified coach and member of the Certified Coaches Alliance, she is also on a mission to encourage others to find their own unique passion and allow it to transform their lives into an exciting adventure. 7 Job-Search Statistics You Should Know
7 Job-Search Statistics You Should Know 7 Job-Search Statistics You Should Know 7 Job-Search Statistics You Should Know Job searching? Get the stats, stat! Searching for a job can be one of the most frustrating, challenging things you'll ever experience. Whether you're looking to make a career change, you're straight out of college, or anywhere in between, the job search brings about the same headaches for all of us. Finding the right formula to help you land that perfect job can be quite a conundrum. No matter how frustrating the process becomes, don't lose hope. These seven amazing job-search statistics will help shed a little light on why the process is so difficult and give you some insight into how you can make the experience easier. Job-Search Statistic #1: 80 percent of jobs are not posted online Websites like Glassdoor and Monster.com can certainly be helpful tools for your job search, but it's important to look beyond the jobs listed online. The large majority of job postings are not available online, which adds an extra level of complexity to your job search. A good way to find out about jobs not posted online is to go directly to the website of the companies that you're targeting. Do a little digging, pinpoint a few decision makers, and start networking. Don't go too high and try to connect with the C-level team to ask about available job positions they likely won't reply. Instead, target those with titles like Director and Manager. They are often the ones who'll be in charge of making hiring decisions. Connect with them and let them know that you're interested in their company. Be ready to point out why you would love to work there, and then ask them if they are aware of any job positions that might be a fit. Don't force your resume on them, however; wait until they ask before you send it along. An uninvited resume can come across as pushy, and employers don't want to bring a pushy person onto their team. Job-Search Statistic #2: More than half of candidates are eliminated from the online job search by applicant tracking systems This statistic highlights the importance of a well-crafted resume. It's critical that you have a high-quality resume that thoroughly details the most valuable aspects of your work experience, but it's also extremely important that you leave room for adjustment. Take the time to thoroughly read the job description of each application and make note of all the keywords that stand out. Applicant Tracking Systems (ATS) allow employers to eliminate resumes that don't match up with the job description, so be sure to take the time to bolster your resume to include the keywords listed in the requirements and other sections of the job posting. Job-Search Statistic #3: 73 percent of companies have used social media to successfully recruit and hire a candidate Social media offers an excellent platform for you to tell employers more about who you are and why they should hire you. Sites like LinkedIn allow you to create a sort of interactive resume by creating an engaging profile, posting your work, publishing articles, and networking with other professionals and recruiters. Sites like Facebook, Instagram, and Twitter, as well as others, have a ton of job-search value, too. These sites allow you to present your expertise as well as your personality. Employers want to know more about you than just your work experience. By visiting your social media profiles, employers can learn a lot about a candidate, so make sure you represent yourself appropriately across all channels on which you're active. Related:Why You Should Google Yourself to Monitor Your Online Personal Brand Job-Search Statistic #4: 70 percent of employers say they've turned down candidates because of something negative they found online There are definitely negative repercussions for not representing yourself appropriately on social media. No matter how amazing your professional background might appear, if employers find something that doesn't jive with their organization on one or more of your social media channels, they'll likely move onto the next job candidate. If you think something you're about to post might potentially be offensive, don't post it. Keep your ranting and raving about sensitive subjects like politics and religion to a minimum, and, of course, remove any photos of yourself in questionable situations. All of these, plus more, are cause for employers to eliminate you from consideration. Job-Search Statistic #5: Only about five applicants actually earn an interview from hundreds of applications Landing the right job is a numbers game the more resumes you send out, the more likely you are to get a callback. An extremely small percentage of those who apply for a job are actually called in for an interview, so by applying to more jobs, you increase your chances. Make sure the jobs you apply to are a fit, of course. Don't apply to jobs just to raise your numbers. Interviewing for a job that you aren't interested in will just waste the employer's time and yours. Job-Search Statistic #6: More than half of people who are currently employed are considering a new job The limited number of callbacks for resumes isn't the only reason to play the numbers game. Keep in mind that you aren't only competing with those without jobs, but over half of current employees are keeping an eye out for also better job opportunities. These individuals will likely bring a good deal of experience to the table, so put yourself and your resume in front of as many employers as possible to give yourself the best shot at landing the job. Related:10 Tips on Effectively Looking for a Job While Employed Job-Search Statistic #7: Referrals account for around a third of all external hires A solid referral can significantly cut down on the number of resumes you need to send out in order to land that job. Having someone vouch for you and your capabilities can go a long way in the eyes of potential employers. It also eliminates a lot of guesswork about things that aren't on your resume, like your character and cultural fit. This is why it's so important to continue to grow and maintain your network. Never pass up a chance to help someone else develop professionally because you never know where they'll end up and whose ear they'll have. If one of your contacts happens to be connected with the hiring manager for a position you're targeting and you've developed your relationship properly, they'll likely be more than happy to vouch for you. That positive referral could be the difference in whether or not you land the job. By paying attention to job-search statistics like these, you can more readily prepare yourself for success and make the job search just a little bit easier. Sales Agreement FAQ - United States
Sales Agreement FAQ - United States Sales Agreement FAQ - United States DefinitionsWhat is an Assignment? An assignment transfers all of the rights and obligations that a party to a contract has to a third party. The party assigning the contract gives up its rights in the contract to the third party, who becomes a contractual party. What is a Carrier?A Carrier is a person or corporation to whom the Seller gives possession of the goods being sold, and the Carrier then delivers the goods to the Purchaser. What is a certified check? It is a check for which payment is guaranteed by the bank. A certified check shows that there are sufficient funds in the account to meet the amount for which the check was drawn. A certified check is less secure than a bank draft but more secure than an uncertified check. What does counterparts mean?Executed in counterparts means that each party can execute a different copy of the contract but all the copies together form a single contract. Usually all the signature pages are gathered together with one copy of the contract. What is a deposit? The deposit is money that the Purchaser is required to provide to the Seller up front, in order to convey that the Purchaser is serious about purchasing the property. The deposit prevents the Seller from selling the property to someone else. Usually, the Purchaser loses this 'earnest money' if the Purchaser fails to complete the transaction. What does Goods in Exchange mean?Goods in Exchange means that the Purchaser will be paying for the Seller's goods by giving the Seller goods, instead of paying with money. The Purchaser may also be required to give the Seller a cash deposit in addition to the goods being exchanged. What is the location of the property? The location of the property is the jurisdiction where the property is situated in or located in the time of the sale. What are patent or trademark infringements?A patent or trademark infringement occurs when a person without authority makes, uses or sells any aspect of a registered patent (product, idea or concept) or trademark (word, phrase or name). What is a Promissory Note?It is a legal document evidencing that the borrower will repay a loan to the lender under the terms agreed upon in the contract. A Promissory Note may also be referred to as an I.O.U. or a Loan Note. What is a security interest?A security interest is an interest in real or personal property that is given to the Seller to secure the payment of an obligation owed by the Purchaser. The holder of the security interest can obtain the secured property in the event of a default. What does Services in Exchange mean?Services in Exchange means that the Purchaser will be paying for the Seller's goods by performing services for the Seller, as opposed to paying with money. The Purchaser may also be required to give the Seller a cash deposit in addition to the services being performed. What is a Warranty? This is a guarantee made by the Seller to the Purchaser as to certain qualities or characteristics of the property. Sales Agreement DetailsI am selling services to the Purchaser. Should I use the Sales Agreement or the Service Agreement?LawDepot.com's Service Agreement would be used if the Seller is selling strictly services to the Purchaser. The Sales Agreement would be used if the Seller is selling either goods or goods and services to the Purchaser. I am selling goods to the Purchaser. Should I use the Sales Agreement or the Bill of Sale? Both of these contracts can be used to sell goods to a Purchaser. However, the Sales Agreement is more extensive than the Bill of Sale and should be used when you want a more detailed sale contract or when payment is not made at the same time the property is transfered. The Bill of Sale can be used when a simple contract evidencing a sale is sufficient. Can I use the Sales Agreement to transfer real estate? No, there are a number of issues not addressed in the Sales Agreement that a real estate transfer must contain. To transfer real estate, use our Real Estate Purchasing Agreement instead. Can I use the Sales Agreement to sell stocks/shares?No, LawDepot.com's Share Purchase Agreement should be used since the Sales Agreement doesn't address all of the relevant issues related to stocks/shares. If I sell the goods as-is without any warranties, what are my liabilities to the Purchaser? The term as-is without any warranties means that the Seller is not guaranteeing the quality of the product to the Purchaser. The Seller is not liable for any imperfections or flaws in the goods. The Seller still could be liable for any fraudulent or intentional misrepresentations that it makes to the Purchaser. However, it is typically buyer beware when you purchase as-is. Who should bear the risk of loss? The risk of loss is borne by the Seller initially, but is eventually transferred to the Purchaser. Typically, the risk of loss is transferred to the Purchaser when the Seller delivers the goods or a bill of sale to the Purchaser, but the risk of loss can also pass to the Purchaser when the Seller transfers the goods to a carrier who will deliver the goods to the Purchaser. How long after delivery does the Purchaser have to make a claim against the Seller? If there is a deficiency in the goods provided, the Purchaser must usually notify the Seller of the defect within 10 days of delivery. After the 10 days has elapsed without notice from the Purchaser, the Seller has no liability to the Purchaser for the goods. Signing DetailsI do not know when the Sales Agreement will be executed. Can I fill in the date later?Yes, by selecting 'Unsure' as the date of execution, a blank line will be inserted into the contract so that you can add the correct date after printing the document. Is the state of execution the same as the location of the property? They can be the same jurisdiction, but do not necessarily have to be. The state of execution refers to the State where the Purchaser and Seller will sign the Sales Agreement. Do I need to have the Sales Agreement witnessed by a third party? Not all jurisdictions require that a Sales Agreement contain witness signatures, but one or two witnesses when the Sales Agreement is signed is better evidence that the parties entered into this agreement if the matter goes to litigation.
